Act to modernize legislative provisions as regards the protection of personal information

As part of the new Act to modernize legislative provisions as regards the protection of personal information (the “Act 25”), which comes into force on September 22, 2022, we appoint Dr. Jean-Marc Dumoulin as the person responsible for the protection of our clients' personal information. Dr. Jean-Marc Dumoulin will be responsible, among other things, for:

  • In the event of a confidentiality incident involving personal information:
    • taking reasonable measures to reduce the risk of harm to the individuals concerned and to prevent new incidents of the same nature from occurring;
    • notifying the Commission d’accès à l’information (“CAI”) and the person concerned if the incident presents a risk of serious harm;
    • maintaining a record of incidents, a copy of which must be sent to the CAI upon request.
  • Complying with the new framework for the communication of personal information without the consent of the person concerned for study, research, or statistical purposes and in the context of a commercial transaction;
  • Conducting a privacy impact assessment (“PIA”) before communicating personal information without the consent of the individuals concerned for study, research, or statistical purposes;
  • Disclosing to the CAI in advance the verification or confirmation of identity carried out using biometric characteristics or measures.
